Responding to Minnesota’s Motion for Summary Judgment, Knife Rights and its fellow plaintiffs have filed their own Motion for Summary Judgment and Opposition To Defendants’ Cross-Motion, and Motion To Exclude Defendants’ Expert Witness Testimony, revealing to the court Attorney General Ellison’s utter disrespect for the law. AG Ellison is making up from whole cloth an imaginary statute that does not exist and then uses that to claim that Minnesota’s switchblade ban is constitutional.
The Supreme Court in Heller and Bruen made it clear that the “plain text” of the Second Amendment is the only thing that matters in considering whether an “arm” is protected. Minnesota’s deceitful attempt to add qualifying conditions of use in self-defense to even be considered “arms” under the Second Amendment’s plain text is shameful.
In keeping with Minnesota’s seeming commitment to fraud and waste in all things, Plaintiffs are forced to repeatedly bring to the court’s attention the lack of rigor in their arguments, which are built on the shakiest of grounds. Our brief walks the Court step-by-step through their utterly irrelevant so-called “expert” testimony. Keep in mind, these are the very same “experts” who we remind the Court admitted they lack the expertise to provide this testimony under long-established precedent.
At its core, the defense brief prioritizes quantity over substance. Its conclusions rest on purported experts who lack the qualifications to support them—turning what should be a dispositive motion into a paper-thin argument built on quicksand, not solid ground.
